2. APPLICATION OF THE GENERAL CONDITIONS OF SALE

These General Conditions of Sale (hereinafter "GTC") define the terms and conditions of sale between the company Croccante and the Customer within the framework of a distance selling system on the Internet and mobile, for goods defined in the catalog of sale of the website and mobile (hereinafter “the Site”). These conditions apply to the exclusion of all other conditions, in particular those in force on other websites or other media.

These GTC are brought to the attention of each Customer to enable them to place an order and make their purchases.

The fact that the Customer completes an order on the Site (filling the basket) and confirming the order (validating the basket) constitutes full and complete acceptance of these GTC, which will only be applicable to the following contract.

Croccante reserves the right to modify in whole or in part and at any time these GTCs.

3. PRODUCTS AND ARTICLES

The products offered to the Customer are those which appear in the catalog published on the Site within the limits of available stocks and subject to the proper functioning of the Site.

Each product is presented with a photograph and a description drawn up by the company Croccante. The descriptions are intended to present to the Customer the essential characteristics of the products before the final order is taken and can in no way engage the responsibility of the company Croccante. Product visuals are provided for information only and are not contractual.

4. ORDER PLACING AND CONFIRMATION PROCEDURE

Taking an order on the Site involves opening a Customer Account by entering two identifiers: an e-mail address and a password. These identifiers are and must be kept confidential. The right of access by the Customer to the identifiers can be made on simple request to the Internet Customer Service of the company Croccante, which will respond only by e-mail to the address used when creating the Customer Account.

The Customer undertakes to complete the order form with precision and to fill in the various existing sections (full name, billing and delivery address, method of payment, etc.). He will receive, after payment, an email confirming the details and terms of his order. The order becomes valid only if all the information requested from the Customer is completed.

By clicking on the icon of the site "Pay", the customer acknowledges having full legal capacity to engage under the General Conditions of Sale, which are the only ones applicable to the following contract. The site is accessible by the customer 24 hours a day, 7 days a week, except during the period of annual leave and in the event of maintenance operations.

Before paying for the order, the Customer declares to have read and accepted these GTCs. The validation of the order therefore implies unreserved acceptance of these GTCs.

For any order modification or cancellation, the Customer must contact the Internet Customer Service no later than the day before the withdrawal before 5 p.m.: by e-mail contact@lapatisseriecyrillignac.com or by telephone 01 55 87 21 40. No refund can be made.

The Croccante company reserves the right to refuse an order in the event of the customer failing to fulfill one of its obligations and more generally, to refuse any order presenting an abnormal or incomplete character for any reason whatsoever. The order is only final after confirmation by the Croccante company. The Croccante company will confirm to the customer the acceptance of his order by email or, where applicable, his refusal within 48 working hours following the entry of his order on the Internet.

5. PRICE

The prices indicated are in Euros including all taxes. VAT included is French VAT applicable on the day of the order. If the VAT rate were to be modified, these changes could be reflected in the price of the items without the Customer being informed beforehand. However, the prices cannot be modified once the order has been confirmed.

Shipping costs include the cost of quality packaging provided by Croccante. Delivery costs are invoiced by the Croccante company. Prices and costs are liable to vary or fluctuate depending on the prices of raw materials and the market in general. The Croccante company leaves itself the possibility of increasing its prices.

Delivery costs are billed in addition to the price of the goods. Delivery rates depend on the delivery method chosen (courier delivery or home delivery), as well as the geographic area.

6. MEANS OF PAYMENT

Payment for products is made by credit card CB, VISA, MASTERCARD and AMEX online from the Site. The validation of payment by credit card is immediate.

The customer can also pay by using the E-Gift Card sold exclusively on the online shop (see terms of purchase and use of our E-Gift Card). Any transaction made with an E-gift card cannot be refunded.

To be registered, the order must be paid in full. Unpaid orders cannot be delivered. In addition, the company Croccante authorizes itself to suspend any order or any delivery in the event of a refusal of authorization of payment by the financial organizations.

7. RIGHT OF WITHDRAWAL

In accordance with the legislation in force, the right of withdrawal does not apply to contracts relating to the supply of perishable and food products, such as products sold by the Site. Also, the Customer cannot rely on it.

For other products, the Customer has a period of fourteen (14) days from receipt of the product to exercise his right of withdrawal from the company Croccante, without having to justify reasons or pay penalties, to end of exchange (subject to availability) or refund or credit. If this period expires on a Saturday, a Sunday or a public holiday, it is extended until the next working day. The right of withdrawal can be exercised on free paper. In the event of transmission online, via the website, an acknowledgment of receipt will be immediately communicated to the Customer by the company Croccante.

The products must be returned within fourteen (14) days following notification to the company Croccante of the Customer's decision to withdraw, accompanied by the confirmation email in their original packaging and in perfect condition allowing their re-marketing to the new condition. Damaged, soiled or incomplete products will not be taken back.

In the event of exercise of the right of withdrawal within the aforementioned period, only the price of the product(s) purchased will be refunded, in full or in the form of a credit note; the return costs will stay the responsibility of the Customer.

The exchange (subject to availability) or credit will be made within fourteen (14) days of receipt by Croccante of the products returned by the Customer under the conditions of this article.

Any modification or cancellation by the Customer may be taken into account 48 hours before the preparation of the order and in any case when the latter has been shipped (except specific order for which no modification may be made after completion). This possibility is appreciated on a case-by-case basis by the company Croccante. From the moment the package has been deposited at the Post Office or handed over to a carrier, no modification or cancellation can be taken into account and the payment made cannot be returned.

8. AVAILABILITY AND GUARANTEE OF PRODUCTS

The products sold on the Site are offered within the limits of available stocks. A product that becomes unavailable will, as soon as possible, be withdrawn from the product catalog or indicated as unavailable for a limited time.

However, if it is impossible to provide the requested products, the Croccante company will contact the Customer by telephone or e-mail as soon as possible in order to agree with him to postpone the delivery pending the replenishment of this product, when this is possible, or to replace the product with another equivalent in quality and price.

Cyril Lignac products are mostly handcrafted and are available in limited quantities. For all intents and purposes, it is important to note that orders placed during the holiday season (end of year holidays in particular) may lead to greater risks of out of stock compared to those made during other periods of the year. and these products cannot be re - later made.

  The Croccante company guarantees the Customer that the products are manufactured and packaged according to strict quality rules, and stored in accordance with the standards in force in France.

However, the company Croccante cannot extend its guarantee on its products if the Customer has not complied with optimal storage conditions, or if it has consumed product beyond the expiry date indicated on the packaging.

9. DELIVERY TERMS

SHOP WITHDRAWAL

In the case of a Shop Withdrawal order, the Customer agrees to come and collect his order from the selected shop the chosen day and during the time slot he has chosen. As the products are perishable, Croccante cannot keep an order that has been forgotten by the Customer. Any forgotten order cannot be refunded under any circumstances.

The Customer must present the necessary supporting documents for the withdrawal of his order: identity document and confirmation email. These supporting documents must correspond to the delivery or billing details entered during the order as well as, where applicable, to the contact details of the holder of the payment card used.

Any order made the day before before 6 p.m. can be collected from the store the next day at 10 a.m. at the earliest (depending on the opening days of the selected store).

COURIER DELIVERY AND HOME SHIPPING

Courier deliveries are made in Paris and Île-de-France within the deadlines indicated when placing the order by the Customer.

Home shipments are made in mainland France (excluding Corsica) and Belgium. Orders are prepared after acceptance of payment by the bank card center and dispatched within 48 to 72 working hours at the latest. Orders placed on Friday after 3 p.m., Saturday and Sunday will be shipped the following Monday and Tuesday (except public holidays).

The Customer is responsible for information relating to the name and address of the recipient. These information must be precise, exact and complete (in particular door and floor code) to allow delivery under normal conditions. The recipient's phone number is required for courier deliveries.

The Croccante company can in no way be held responsible for a return delivery due to an address error or an inability to deliver to the address indicated. 
In the event that a delivery address is incomplete or imprecise, Croccante reserves the right to contact the recipient directly by telephone in order to complete with him the missing delivery information insofar as the telephone number is not incorrect and the recipient in available.

Orders indicating a PO box address cannot be taken into account and processed. The company cannot be held responsible if the product could not be delivered in the event of natural disasters or force majeure.

In the absence of the recipient or of a person who can take possession of the products during delivery, and to the extent that he will have access to the recipient's mailbox, the carrier will leave a transit advice note inviting the recipient to come. pick up your product at an agency or relay point. As part of a delivery by courier, in the absence of the recipient, the products being perishable, the Croccante company cannot keep the order. Any order not received can in no case be refunded.

In the event of a return of a parcel, Croccante will proceed with the destruction of the food products and no refund or replacement request can be made by the customer.

However, if the customer wishes to receive his order again, a payment of 10 € will be requested for the re-shipment.

In any case, the Croccante company cannot be held responsible for any deterioration of the products due to their late withdrawal from the carrier. Exceeding delivery times cannot give rise to damages. The delivery time cannot be guaranteed, especially during holiday periods such as Christmas, Easter, Valentine's Day, Mother's Day, etc. During these periods, orders delivered late cannot benefit from a credit.

The Croccante company reserves the right to advise against even stop sending certain sensitive products during periods of high heat.

10. TRANSFER OF OWNERSHIP AND TRANSFER OF RISK

The Croccante company insures the goods up to the place of delivery. The risk of transport is borne by the buyer. It is for the recipient to check the shipments upon arrival and to all reserves that would appear justified, or even refuse the package if it is likely to have been opened or s ' he wears deterioration.

Finally, if the product, under the responsibility of the courier, has not been delivered, for any other cause related to customs, strikes or damage or any other cause of force majeure as defined by the courts, the sale may then be resolved. and the Customer may obtain a refund of his price to the exclusion of any other compensation or damages.

11. CLAIMS AND DISPUTES

Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to expose the dispute.

The Customer is required to ensure the conformity of his order at the time of its withdrawal. Once the order has been withdrawn, no complaint of non-compliance will be accepted. In the case of a delivery, the Customer is required to ensure the conformity of his order. If the order turns out to be non-compliant, an email must be sent to customer service within 72 hours with a photo of the point of dispute raised.

After analysis and if acceptance of the complaint by the company Croccante, a commercial gesture, credit or refund will be offered to the Customer.

In accordance with Article L. 612-1 of the Consumer Code, the consumer has the right to submit a request for an amicable resolution by mediation, within a period of less than one year from his written complaint to the professional.

Croccante has appointed SAS Médiation Solution as the consumer mediation entity. To enter the mediator, the consumer must make his request:

Whatever the means of referral used, the request must contain:

  • The postal, telephone and electronic contact details of the applicant,
  • A brief statement of the facts. The consumer will tell the mediator what he expects from this mediation and why,
  • Copy of the prior complaint,
  • all documents allowing the processing of the request (order form, invoice, proof of payment, etc.)

12. INTELLECTUAL PROPERTY AND PROHIBITION

The structure, the layout, the graphics, texts, the databases, images, photographs, sounds, videos and other material from the Site are and remain the intellectual property and proprietary company Croccante and are protected by copyright. The brands, trade names and logos appearing on this site are registered trademarks unless otherwise stated.

The reproduction, redistribution or use for any purpose whatsoever, even partially, of the elements of the Site are subject to the express prior authorization of the company Croccante, holder of all intellectual property rights. The user who has an Internet site and who wishes to place on his site a simple link directing to the site must first seek the authorization of the company Croccante. 

The customer must not in any case resell the products which are intended for his personal use or that of the recipient of his order. Any total or partial reproduction, modification or use of the products or their images for any reason whatsoever is strictly prohibited.

13. PROTECTION OF PERSONAL DATA

In accordance with Regulation 2016/679 of April 27, 2016 relating to the protection of individuals with regard to the processing of personal data and the free movement of such data, the Seller sets up a processing of personal data which has the purpose of purpose the sale and delivery of products and services defined in this contract. The Buyer is informed of the following:

In accordance with articles 39 and 40 of the “Informatique et Libertés” law of January 6, 1978, the Customer has the right to access, rectify and delete data concerning him. To exercise this right and obtain information, the Customer may contact Croccante at contact@lapatisseriecyrillignac.com.

14. INDEPENDENCE OF CLAUSES

If one of these general conditions should be declared inapplicable or is invalidated for any reason, this invalidity will not affect the application or the validity of the other provisions of the general conditions, that invalidated or deemed inapplicable being then replaced by the provision as close as possible.

15. FORCE MAJEURE

Neither Croccante nor the Client can be held responsible in the event of non-performance, non-performance or delay in the performance of one of its obligations described in these T & Cs which could be caused by a case of force. major, as defined by the courts.

16. APPLICABLE LAW

These general conditions are governed exclusively by French law. The language of this contract is French. In case of translation, only the French version is authentic. Any dispute will fall under the jurisdiction of the Commercial Court of Bobigny once the amicable channels have been exhausted. The responsibility of the company Croccante cannot be engaged in the event of non-compliance with the regulations of a foreign country where the products marketed on this site are delivered.
